Article 1 — Governing Law & Jurisdiction
These terms are governed by Italian law under Legislative Decree 79/2011 (Tourism Code), as amended by Legislative Decree 62/2018 implementing EU Directive 2015/2302 on Package Travel.
The Italian jurisdiction shall have exclusive jurisdiction over any legal dispute which might arise concerning the interpretation, application and enforcement of the contracts.
Article 2 — Tourist Package Definition
A tourist package is defined as the combination of at least two different types of tourist services for the purpose of the same trip or holiday, combined either by a professional (directly or through a third party), or when those services are purchased through linked online booking processes within 24 hours of each other.
Tourist services include: transport, accommodation, rental of cars or motorcycles, and any other tourist service that is not ancillary to transport or accommodation and accounts for a significant proportion of the package.
Article 3 — Pre-Contractual Information
Before the traveler is bound by any package travel contract, Via Panoramica shall provide the following information:
- Main characteristics of the travel services: destination(s), itinerary and periods of stay, type and category of transport including means, departure and arrival points, dates and times
- Name, address, telephone number and, where applicable, e-mail address and fax number of the organiser
- The total price inclusive of taxes and, where applicable, all additional fees, charges and other costs
- Payment arrangements, including the amount or percentage of the price to be paid as a down payment and the timetable for the payment of the balance
- Minimum number of persons required for the package and the deadline for notifying the traveler if the package is cancelled due to insufficient bookings
- Passport and visa requirements, including approximate time for obtaining visas, and health formalities
- Information about optional or compulsory insurance to cover costs of cancellation or assistance
Article 4 — Contract Conclusion
The package travel contract shall be concluded when the organiser confirms the traveler's booking in writing on a durable medium. A five-day right of withdrawal applies for contracts concluded off-premises, except where the contract concerns a package whose price is significantly discounted.
The traveler shall receive a copy or confirmation of the contract on a durable medium. The contract shall include all pre-contractual information and the full agreed package content.
Article 5 — Traveler Obligations
Travelers are responsible for:
- Verifying passport and visa requirements independently and ensuring their documents are valid for the duration of travel
- Checking any health or vaccination requirements applicable to the destinations visited
- Consulting the Italian Ministry of Foreign Affairs travel advisories at www.viaggiaresicuri.it before departure
- Complying with all instructions issued by the organiser and/or guide during the tour
- Informing the organiser promptly of any non-conformity identified during the execution of a travel service
Article 6 — Payment Terms
A down payment is required upon signing the contract, with the balance due according to the organiser's schedule as specified in the booking confirmation. Failure to pay the balance by the due date constitutes automatic termination of the contract.
Full payment is required at the time of booking for reservations made within 30 days of the departure date.
Article 7 — Price Changes
After conclusion of the contract, prices may only be increased if the contract expressly provides for this possibility and states that the traveler is entitled to a reduction. Price increases are permitted solely in response to changes in:
- The cost of passenger transport resulting from the cost of fuel or other power sources
- The level of taxes or fees applicable to travel services included in the contract
- Exchange rates relevant to the package
The maximum permitted price increase is 8% of the total package price. Any increase shall be notified to the traveler on a durable medium with clear justification and calculation at least 20 days before the start of the package.
Article 8 — Modifications Before Departure
Before the start of the package, the organiser may not unilaterally alter the package travel contract other than a change in price as set out in Article 7. If the organiser is constrained to make significant changes to any of the main characteristics of the travel services, the traveler shall be informed promptly and may accept the modification or withdraw from the contract without paying any termination fee.
Article 9 — Cancellation by the Organiser
The organiser may cancel the package and provide the traveler with a full refund if the minimum number of persons required for the package is not reached, provided that:
- The organiser notifies the traveler not later than 20 days before the start of the package for trips lasting more than 6 days
- Not later than 7 days before the start of the package for trips lasting between 2 and 6 days
- Not later than 48 hours before the start of the package for trips lasting less than 2 days
The organiser may also cancel and fully reimburse the traveler if prevented from performing the contract because of unavoidable and extraordinary circumstances, without being liable for additional compensation.
Article 10 — Traveler Withdrawal
The traveler may withdraw from the package travel contract at any time before the start of the package. The traveler shall pay an appropriate and justifiable termination fee to the organiser, based on reasonable documented cancellation costs. Standard indicative fees are as follows:
- More than 30 days before departure: loss of deposit
- 15–30 days before departure: 30% of the total price
- 8–14 days before departure: 50% of the total price
- 3–7 days before departure: 75% of the total price
- Less than 3 days / no-show: 100% of the total price
The traveler is entitled to withdraw without paying any termination fee in the event of unavoidable and extraordinary circumstances occurring at or in the vicinity of the place of destination and significantly affecting the performance of the package.
Article 11 — Package Transfer
The traveler may transfer the package to another person who satisfies all the conditions applicable to the contract, provided that the organiser is notified on a durable medium at a reasonable time before the start of the package, which in any case shall be no later than 7 days before the start.
Both the original traveler and the person to whom the package is transferred shall be jointly and severally liable for payment of the balance and any additional fees, charges and other costs arising from the transfer.
